Ouida Sue Parker v. Metropolitan Life Insurance, 121 F. 3d 1006 (6th Cir. 1997), cert denied, No. 97-747, __U.S.__, 1998 WL 15861 (Jan 20. 1998)
An employee sued her employer and its insurance carrier claiming that the employer's long-term disability plan violated the public accommodations provisions of the Americans With Disabilities Act (ADA). The plan provided greater benefits to those who become disabled due to physical illness as opposed to mental illness. The court held that the public accommodations title of the ADA does not prohibit an employer from providing long-term disability plans with differing benefits periods for physical and mental illness.
