EPA Extends Stay On Section 126 Petitions

On May 25, 1999, EPA made a final determination that portions of petitions filed by Pennsylvania and other Northeastern states under Section 126 of the Clean Air Act Amendments of 1990 were technically meritorious. The petitions were filed seeking mitigation from the effects of significant transport of NOx from sources in states upwind from the petitioners. Subsequently, however, the U.S. Court of Appeals for the District of Columbia Circuit remanded to EPA the eight - hour ambient air quality standard for ozone, which formed part of the underlying technical basis for EPA's final determination on the Section 126 petitions. Consequently, on June 24, 1999, EPA stayed the effect of that determination until November 30, 1999. On December 3, 1999, EPA extended that stay until January 10, 2000.
