New Wastewater Management Regulations

On January 29, 2000, the Environmental Quality Board published new wastewater management regulations effective on that date. The regulations provide for the issuance of general water quality management permits for wastewater treatment facilities under the following conditions: (1)the facilities involve the same, or substantially similar type of operations; (2)the facilities treat the same types of waste; (3)the facilities require the same operating conditions; and (4)the facilities are in the judgment of the Department more appropriately managed under a general permit than under individual permits. The regulations include a requirement that those engaged in the impoundment, production, processing, transportation, storage, use, application or disposal of "pollutants" shall take necessary measures to prevent the substances from directly or indirectly reaching waters of the Commonwealth. "Pollutant" is defined as "a contaminant or other alteration of the physical, chemical or biological properties of surface water which causes or has the potential to cause pollution." Furthermore, the Department may require a person to submit a report or plan showing how those performing the activities described above will prevent pollutants from reaching waters of the Commonwealth. The regulations also provide for compliance with approved manure management practices at animal manure storage facilities and in the land application of animal manure.
