Probate of Estates

The probate of an estate refers to the process by which a person's assets are distributed after his death. The elder law attorney often administers an estate by preparing probate documents, probate forms, tax returns, an inventory of estate assets and other estate records.

Let us suppose that a person dies without having a will. This is referred to as dying intestate. When someone dies intestate there is no Last Will and Testament to tell us where the house and the money should be distributed. Instead, we have to look at the laws of intestacy. The laws of intestacy have rules as to who receives the property. Generally, these rules provide for the distribution of the assets to close family members.
