TZBZU Prevails: Recently we were able to obtain a very substantial victory on behalf of an assisted living facility in an administrative hearing for the Agency for Health Care Administration. The AHCA cited the facility for numerous, serious violations after a resident wandered from the facility during the night. The hearing officer found that the facility's staff was properly trained, acted properly in monitoring the resident, acted properly in searching for the resident and was not at fault for her disappearance. The matter will now move on for the issuance of a final order by the AHCA, which is bound by the hearing officer's findings of fact.
