The answer depends on whether the employer is a public or private entity, the type of speech involved, and the employee\u2019s position.<\/p>\n<p><b>No Constitutional Freedom of Speech in the Private Sector<\/b><\/p>\n<p>Employees in the public sector \u2013 who work for governmental entities \u2013 have First Amendment rights in the workplace, subject to <a title=\"The Supreme Court Finds No First Amendment Protection for Government Employee Speech Pursuant to Official Duties\" href=\"https:\/\/supreme.findlaw.com\/legal-commentary\/the-supreme-court-finds-no-first-amendment-protection-for-government-employee-speech-pursuant-to-official-duties.html\" target=\"_blank\" rel=\"noopener\">certain restrictions<\/a>. The case law that has developed over time regarding First Amendment rights in the workplace has come from the public sector, as the government is directly affecting employees in public sector cases. Private citizens do not enjoy the same protections.<\/p>\n<p><b>Other Freedom of Speech Issues in the Private Sector<\/b><\/p>\n<p>Employees who work in the private-sector do not, as a rule, have First Amendment protection for their speech in the workplace. On one level, a private sector employer could take the absence of a direct First Amendment right as providing free rein to discipline, terminate or retaliate against employees for their speech in the workplace. Before doing so, however, the private sector employer should take into account the effect of the <a title=\"Prohibited Employment Policies\/Practices\" href=\"https:\/\/www.eeoc.gov\/laws\/practices\/\" target=\"_blank\" rel=\"noopener\">anti-discrimination laws<\/a> such as Title VII, RCW 49.60 (the <a title=\"Washington Revised Code Title 49. Labor Regulations \u00a7 49.60.010. Purpose of chapter\" href=\"https:\/\/codes.findlaw.com\/wa\/title-49-labor-regulations\/wa-rev-code-49-60-010.html\" target=\"_blank\" rel=\"noopener\">Washington Laws Against Discrimination<\/a> or \u201cWLAD\u201d), <a title=\"U.S. Department of Labor: Whistleblower Protection Programs\" href=\"https:\/\/www.whistleblowers.gov\/\" target=\"_blank\" rel=\"noopener\">whistle blower laws<\/a>, and various local laws.<\/p>\n<p>These laws provide a level of protection for certain types of expression in the workplace, and thus should be considered even if the right of speech associated with these laws is not a \u201cFirst Amendment\u201d right per se. For example, punishing an employee because of his religion is not technically a First Amendment violation in the private sector, but it would be a violation of the anti-discrimination laws. Conversely, the anti-discrimination laws prohibit certain types of expression on the part of employers, such as comments that constitute sexual or racial harassment, thereby putting a limit on \u201cfree speech\u201d in the workplace.<\/p>\n<p><b>The Bottom Line<\/b><\/p>\n<p>Even though the First Amendment free speech criteria do not apply to private employers, determine if there is some other interest that governs the employee\u2019s ability to speak freely. The following are some examples:<\/p>\n<ul>\n<li>Is this employee\u2019s speech being restricted or punished because the employee is expressing religious or other beliefs that are different from the employer\u2019s or from co-workers?<\/li>\n<li>Are employees of some religions or <a title=\"Ethnic\/National Origin\" href=\"https:\/\/www.dol.gov\/general\/topic\/discrimination\/ethnicdisc\" target=\"_blank\" rel=\"noopener\">national origins<\/a> allowed to express themselves regarding religion or national origin, but not others?<\/li>\n<li>Is the employee being punished for speaking a different language during lunch or breaks?<\/li>\n<li>Are the employee\u2019s rights to share information protected by some other right, e.g. union regulations under the <a title=\"National Labor Relations Board: Employee Rights\" href=\"https:\/\/www.nlrb.gov\/rights-we-protect\/employee-rights\" target=\"_blank\" rel=\"noopener\">NLRB<\/a> or <a title=\"Washington State Public Employment Relations Commission\" href=\"https:\/\/perc.wa.gov\/\" target=\"_blank\" rel=\"noopener\">PERC<\/a> that allow employees to share salary information?<\/li>\n<\/ul>\n<p>Additionally, determine whether the employer has a duty to restrict the employee\u2019s speech. For example:<\/p>\n<ul>\n<li>Does the employee\u2019s speech violate the anti-harassment or <a title=\"Laws Enforced by EEOC\" href=\"https:\/\/www.eeoc.gov\/laws\/statutes\/\" target=\"_blank\" rel=\"noopener\">anti-discrimination laws<\/a>, including local ordinances?<\/li>\n<li>Are other employees using speech or expression to <a title=\"Retaliatory Harassment Actionable under Title VII\" href=\"https:\/\/corporate.findlaw.com\/human-resources\/retaliatory-harassment-actionable-under-title-vii.html\" target=\"_blank\">retaliate<\/a> against an employee for exercising his or her legal rights?<\/li>\n<li>Is the employee entitled to <a title=\"Whistleblower Protection Enhancement Act of 2012 Becomes Law\" href=\"https:\/\/corporate.findlaw.com\/human-resources\/whistleblower-protection-enhancement-act-of-2012-becomes-law.html\" target=\"_blank\">whistleblower protection<\/a>?<\/li>\n<\/ul>\n<p>By addressing the above questions, you should begin to develop a sense of whether the employee\u2019s freedom of speech has been violated.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>FindLaw&#8217;s analysis of whether speech protections under the First Amendment apply in a given workplace.<\/p>\n","protected":false},"template":"","meta":{"_acf_changed":false,"_stopmodifiedupdate":true,"_modified_date":"","_cloudinary_featured_overwrite":false},"corporate_categories":[6500,6501,6497],"class_list":["post-34977","corporate","type-corporate","status-publish","hentry","corporate_categories-law-library__communications-law","corporate_categories-law-library__constitutional-law","corporate_categories-law-library"],"acf":[],"_links":{"self":[{"href":"https:\/\/corporate.findlaw.com\/legal-api\/wp-json\/wp\/v2\/corporate\/34977","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/corporate.findlaw.com\/legal-api\/wp-json\/wp\/v2\/corporate"}],"about":[{"href":"https:\/\/corporate.findlaw.com\/legal-api\/wp-json\/wp\/v2\/types\/corporate"}],"wp:attachment":[{"href":"https:\/\/corporate.findlaw.com\/legal-api\/wp-json\/wp\/v2\/media?parent=34977"}],"wp:term":[{"taxonomy":"corporate_categories","embeddable":true,"href":"https:\/\/corporate.findlaw.com\/legal-api\/wp-json\/wp\/v2\/corporate_categories?post=34977"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
