{"id":42121,"date":"2015-09-17T11:25:58","date_gmt":"2015-09-17T16:25:58","guid":{"rendered":"https:\/\/content.findlaw-admin.com\/ability-legal\/contracts\/uncategorized\/capital-construction-fund-agreement-us-department-of3.html"},"modified":"2015-09-17T11:25:58","modified_gmt":"2015-09-17T16:25:58","slug":"capital-construction-fund-agreement-us-department-of3","status":"publish","type":"corporate_contracts","link":"https:\/\/corporate.findlaw.com\/contracts\/operations\/capital-construction-fund-agreement-us-department-of3.html","title":{"rendered":"Capital Construction Fund Agreement &#8211; US Department of Transportation, Maritime Administration, and National Steel and Shipbuilding Co."},"content":{"rendered":"<pre>                                                  Addendum No. 4\n                                                  Contract No. MA\/CCF-478\n\n                                  ADDENDUM TO\n                            MARITIME ADMINISTRATION\n                      CAPITAL CONSTRUCTION FUND AGREEMENT\n                                      WITH\n                    NATIONAL STEEL AND SHIPBUILDING COMPANY\n\n    This Addendum is made by and between the Maritime Administrator (the\n'Administrator'), and the National Steel and Shipbuilding Company, a citizen of\nthe United States (the 'Party'), as an addendum to that certain Capital\nConstruction Fund ('CCF') Agreement Contract No. MA\/CCF-478 (the 'Agreement').\n     WHEREAS: \n     1.   The Administrator and the Party entered into the Agreement on\nSeptember 13, 1988, under Section 607, Merchant Marine Act, 1936, as amended\n(the 'Act'); \n     2.   The Administrator approved the replacement of the existing\nSchedule B with the revised attached Schedule B which would: a) delete the\nconstruction of the R.J. PFEIFFER since the vessel has been delivered; b) add\nthe acquisition\/construction of two Roll-on-Roll-off Trailer vessels at an\nestimated cost of $135 million each, of which approximately $80 million is to be\npaid by qualified CCF withdrawals; c) increase the acquisition\/construction\ncost of two 500 plus passenger cruise vessels from approximately $200 million\neach to $400 million each\n\n                                       2\n\nand increase the amount to be paid by qualified CCF withdrawals to approximately\n$80 million; d) delete the acquisition\/construction of two 40,000 DWT product \ntankers at an estimated cost of $160 million to be delivered in 1993; and e) \nadd the acquisition\/construction of three 140,000 DWT product tankers at an \nestimated cost of $200 million each, of which approximately $80 million is to \nbe paid by qualified CCF withdrawals.\n\n     NOW THEREFORE, the Administrator and the Party agree as follows:\n\n     I.   Effective August 28, 1997, the Agreement is amended by deleting the \nexisting Schedule B and replacing it with the annexed revised Schedule B.\n\n     II.
