{"id":42122,"date":"2015-09-17T11:25:58","date_gmt":"2015-09-17T16:25:58","guid":{"rendered":"https:\/\/content.findlaw-admin.com\/ability-legal\/contracts\/uncategorized\/capital-construction-fund-agreement-us-department-of5.html"},"modified":"2015-09-17T11:25:58","modified_gmt":"2015-09-17T16:25:58","slug":"capital-construction-fund-agreement-us-department-of5","status":"publish","type":"corporate_contracts","link":"https:\/\/corporate.findlaw.com\/contracts\/operations\/capital-construction-fund-agreement-us-department-of5.html","title":{"rendered":"Capital Construction Fund Agreement &#8211; US Department of Transportation, Maritime Administration, and National Steel and Shipbuilding Co."},"content":{"rendered":"<pre>                                                                  Addendum No. 3\n                                                         Contract No. MA\/CCF-478\n\n                                  ADDENDUM TO\n                            MARITIME ADMINISTRATION\n                      CAPITAL CONSTRUCTION FUND AGREEMENT\n                                      WITH\n                    NATIONAL STEEL AND SHIPBUILDING COMPANY\n\n\n     THIS AGREEMENT, made by and between the Maritime Administrator, Department \nof Transportation (the 'Maritime Administrator') and National Steel and \nShipbuilding Company ('NASSCO'), a citizen of the United States, as an Addendum \nto that certain agreement, Contract No. MA\/CCF-478.\n\n     WHEREAS on September 13, 1988, the parties hereto entered into a Capital \nConstruction Fund Agreement as amended by Addendum No. 1 dated September 13, \n1988 and Addendum No. 2 dated October 29, 1992 (the 'Agreement'), under \nSection 607 of the Merchant Marine Act, 1936, as amended (the 'Act');\n\n     WHEREAS, the parties hereto desire to amend the Agreement in the manner \nhereinafter set forth; and\n\n     WHEREAS, the parties hereto have agreed to this amendment and desire to \nincorporate the same into the Agreement.\n\n     NOW, THEREFORE, in consideration of the premises and for other good and \nvaluable consideration, the receipt and adequacy of which are hereby \nacknowledged, the Maritime Administrator and NASSCO agree as follows:\n\n     I.   NASSCO Holdings, Incorporated ('NHI'), the parent of NASSCO, and \nNASSCO Funding Corporation ('NFC'), a wholly owned subsidiary of NHI, both \ncitizens of the United States, are hereby added as parties to the Agreement \neffective as of the date hereof. The defined term 'Party' shall mean any or all \nof NHI, NASSCO, or NFC, as the case may be.\n\n     II.  Schedule C to the Agreement is hereby amended by replacing the \nSchedule C dated 7\/01\/92 with the Schedule C attached hereto.\n\n     III.
