{"id":42123,"date":"2015-09-17T11:25:58","date_gmt":"2015-09-17T16:25:58","guid":{"rendered":"https:\/\/content.findlaw-admin.com\/ability-legal\/contracts\/uncategorized\/capital-construction-fund-agreement-us-department-of7.html"},"modified":"2015-09-17T11:25:58","modified_gmt":"2015-09-17T16:25:58","slug":"capital-construction-fund-agreement-us-department-of7","status":"publish","type":"corporate_contracts","link":"https:\/\/corporate.findlaw.com\/contracts\/operations\/capital-construction-fund-agreement-us-department-of7.html","title":{"rendered":"Capital Construction Fund Agreement &#8211; US Department of Transportation, Maritime Administration, and National Steel and Shipbuilding Co."},"content":{"rendered":"<pre>\n                                                         Addendum No. 2\n                                                         Contract No. MA\/CCF-478\n\n                                  ADDENDUM TO\n                            MARITIME ADMINISTRATION\n                      CAPITAL CONSTRUCTION FUND AGREEMENT\n                                      WITH\n                    NATIONAL STEEL AND SHIPBUILDING COMPANY\n\n     This Addendum is made by and between the Maritime Administrator (the \n'Administrator'), and National Steel and Shipbuilding Company, a citizen of the \nUnited States (the 'Party'), as an addendum to that certain Capital \nConstruction Fund ('CCF') Agreement Contract No. MA\/CCF-478 (the 'Agreement').\n\n     WHEREAS:\n\n     1.   The Administrator and the Party entered into the Agreement on \nSeptember 13, 1988 under Section 607, Merchant Marine Act, 1936, as amended \n(the 'Act');\n\n     2.   The Administrator on August 6, 1992, approved the amendment of \nSchedule A of the Agreement to delete the SS WORTH (Official No. 7600548), the \nSS ROSE CITY (Official No. 7607891), the MR. ED (Official No. 575765) and the \nHAPPY (Official No. 228709) from the list of eligible agreement vessels;\n\n     3.   The Administrator on August 6, 1992, approved an amendment to \nSchedule B to\n\n               A.   Delete the construction\/acquisition of a 209,000 DWT Alaska\nClass Tanker with an estimated contract price of $130 million to be delivered in\nJanuary 1991;\n\n\n\n\n                                       2\n\n               B.   Add the construction\/acquisition of two 40,000 DWT product\ntankers with an estimated contract price of $160 million to be delivered in\n1993;\n\n               C.   Change the construction\/acquisition of a passenger cruise\nship of about 1,800 passenger capacity for operation in inter-island Hawaii with\nan estimated contract price of $225 million to two 500-plus passenger cruise\nships to be delivered in 1994 with an estimated contract price of $200 million\neach;\n\n               D.   Change the construction\/acquisition of two 2,000 TEU\ncontainerships with an estimated contract price of $200 million to the R.J.\nPFEIFFER, a 2,000 TEU containership to be delivered on June 15, 1992 with an\nestimated contract price of $120 million;\n\n     4.   The Administrator on August 6, 1992 approved the amendment of Schedule\nC to reflect changes in names from West One Trust to West One Bank, Idaho and\nfrom Citicorp Bank to Citicorp Trust of California. The approval also added\nSanwa Bank California and The Bank of California as depositories.\n\n     5.   The Parties desire to amend the agreement as set forth in this\nAddendum.\n\nNOW, THEREFORE, the Administrator and the Party agree as follows:\n     I.   Effective August 6, 1992, the agreement is amended by deleting the\nexisting Schedules A, B and C and replacing them with the annexed revised\nSchedules A, B and C.\n\n\n\n                                       3\n\n\n     II.
