When you are involved in an automobile accident, there is often a great deal of confusion. At Green, Kaster & Falvey, P.A., we help our clients cope with the consequences of the accident and, if the injuries are serious, we assist our clients in pursuing their claims against the at-fault party. We provide a variety of services to clients who have been injured in automobile accidents.
We employ a full-time investigator/paralegal to take photographs of the accident vehicles and the scene of the accident as well as obtain sworn statements from any eyewitnesses. Often times, we will employ expert witnesses who provide testimony regarding how the accident occurred, vehicle speeds, forces involved in the accident, visibility conditions and bio-mechanical issues.
If you have been injured in an automobile accident, one of the first considerations is to ensure that you are getting appropriate medical attention. Where necessary, we assist our clients in finding medical care providers who are competent in treating their patients and are not biased in favor of insurance companies. As the claim is proceeding, we obtain copies of our clients' medical records and monitor their recovery.
Florida law requires owners or registrants of motor vehicles required to be registered and licensed in this state to carry "no-fault" insurance. Florida's no-fault insurance law provides medical, surgical, funeral and disability insurance benefits without regard to fault. Generally speaking, under Florida law, no-fault insurance will pay 80% of reasonable medical expenses related to injuries sustained in the accident and 60% of lost earnings subject to the limits of the no-fault coverage and any applicable deductible. If you have been involved in an automobile accident, we will examine your insurance coverage and explain your benefits to you. If your Florida auto insurer wrongfully refuses to pay benefits on your behalf, we will bring suit to help recover any benefits to which you are legally entitled.
Under Florida law, in order to recover damages for pain, suffering, mental anguish, and inconvenience because of injuries sustained in an automobile accident, the injured party must establish a significant and permanent loss of an important bodily function, a permanent injury within a reasonable degree of medical probability, significant and permanent scarring or disfigurement, or death. We assist our clients who have sustained serious injuries in establishing that their injuries satisfy the statutory criteria to allow recovery of such damages.
