DUI

You should know that anyone charged with DUI faces certain mandatory sentences which may include:

  • a minimum 6 month drivers license suspension
  • a period of probation
  • a possible jail sentence
  • community service
  • DUI school/alcohol evaluation, fines and court costs
  • mandatory 10 day vehicle impoundment
You should also know that if your license was taken at the time of your arrest, you have the right to a review hearing to determine the validity of the immediate loss of your license. However, you must act within 10 days from the date of your arrest or you forfeit this right.

Being arrested is one of the most frightening and humiliating experiences of your life. Some of the questions you may have might include:

  • What will happen to me now?
  • Am I facing mandatory jail time or a fine and probation?
  • How long will my license be suspended if I am convicted?
  • Will I be able to get a work permit to drive if I am convicted?
  • Do I have any possible defenses even though I took the breath test and field sobriety tests?
  • Is all of the State's evidence against me admissible in court?
  • Is it possible to have my case reduced to a lesser offense such as reckless driving?
A thorough review of the police report, breath test results and video tape of your arrest may reveal possible defenses not readily apparent.
