Both Federal and Florida law provide remedies for victims of sexual harassment and discrimination. Federal remedies for sexual harassment and racial discrimination in employment can be found in Title VII of the Civil Rights Act of 1964. Title VII applies to employers with 15 or more employees and requires the claimant to file administrative charges within a limited time period. Claims must be filed with the Equal Employment Opportunity Commission.
Similarly, Chapter 760 of the Florida Statutes provides remedies for individuals discriminated because of race or sex. The Florida Civil Rights Act applies to employers with 15 or more employees. Under the Florida Act, claimants may elect to file an administrative claim with the Florida Human Relations Commission within a limited time period.
